SiteZero Internet Pty Ltd

The Client has agreed with the Terms and Conditions set out in this agreement.

The "user licence/use/rental" of the SiteZero Content Management (CM) System is subject to the following Terms and Conditions:

The SiteZero CM System

1. The 'SiteZero CM System' refers to all SiteZero Internet Pty Ltd software applications that may be connected to, or used via a connection with SiteZero Internet Pty Ltd and our nominated ISP.

2. SiteZero Internet Pty Ltd does NOT guarantee that data or information provided by the SiteZero CM System will be error free, uninterrupted or suitable for any particular purpose. Under no circumstances shall SiteZero Internet Pty Ltd be liable for any loss, damage or injury including without limitation any loss of profit, indirect (consequential or incidental loss damage or injury) arising from the use of the SiteZero CM System or information obtained from it.

3. SiteZero Internet Pty Ltd does not guarantee that access to any SiteZero CM System will be available at any given time.

4. SiteZero Internet Pty Ltd reserves the right to alter the SiteZero CM System Terms and Conditions as required without notice.

5. Nominated ISP - SiteZero Internet Pty Ltd reserves the right to move clients using SiteZero CM System to it's nominated ISP at any time without notice.

6. The 'client' refers to the person or device that connects to the SiteZero CM System for editorial purposes and is registered for use of the SiteZero CM System .

7. The client shall not engage in uploading of software or information on the SiteZero CM System that (i) breaches commercial copyright (ii) is unlawful and which may constitute criminal activity (iii) is obscene or abusive.

8. The client shall provide correct name, address and contact information when registering for use of the SiteZero CM System and will notify SiteZero Internet Pty Ltd of any changes.

9. With access to any SiteZero CM System, the client has full responsibility legally and ethically for their own actions. SiteZero Internet Pty Ltd can in no way be held liable for any activity and exclusions caused by the client.

10. The client is also aware that SiteZero Internet Pty Ltd can in no way be held liable for any activity and exclusions caused by authorised or un-authorised access to the SiteZero CM System .

11. Monthly Payments - ALL ongoing payments are due and payable by the FIRST of each month (i.e. the client pays in advance for use of the SiteZero CM System). All Monthly Ongoing charges are automatically generated on a calendar basis (NOT anniversary), and charges will continue to be generated until such time as notification in writing is received from the client to cancel the account. The first monthly charge will be on a pro rata basis.   SiteZero CM System activation and e-mail is only available on the condition that the monthly ongoing payments are received in accordance with OUR TERMS. The client is responsible for payment of all charges linked to the account. Charges on the account begin once SOFTWARE ACTIVATION/AUTHORIZATION has been given to SiteZero Internet Pty Ltd to commence production on your website, NOT from when CONTENT/DATA/GRAPHIC ART is uploaded to the SiteZero CM System . SiteZero Internet Pty Ltd at all times reserves the right to alter pricing on monthly ongoing payments as SiteZero Internet Pty Ltd deems fit.

12. Invoices - invoices are automatically e-mailed to all clients from the 25th of the preceding month. It is the client's responsibility to ensure payments are made in accordance with OUR TERMS and advise our accounts department of any change to your e-mail address.

13. Payments - may be made by Credit Card and Direct Debit only unless previously arranged. SiteZero Internet Pty Ltd reserves the right to charge a fee (10%) for alternative payment options other than those stated as being accepted. For credit card customers, the balance on your account will automatically be charged to your credit card. (If your card fails to authorize, your account will be overdue). It is your responsibility to notify SiteZero Internet Pty Ltd of any changes to your credit card details. Overdue Accounts - If there has been no written notification from the client to cancel the account by the 28th of preceding month, the client is responsible for payment of all charges on the account for the next month. If by the 3rd of the month no contact has been made and your credit card fails to authorize the account will now be considered Overdue, and the following steps will be taken automatically.

14. Cancellation - If account remains unpaid by the 7th day of the month and there has been no contact, the account will be CANCELLED. This will result in LOSS OF ALL E-mail Addresses and ALL E-mail; ALL Site Contents including any orders from the site that maybe in the system. It is impossible to recover any mail/data deleted from our server and SiteZero Internet Pty Ltd does not take responsibility for loss of data.

15. Reactivation - Should the client wish to reactivate the account, a reactivation fee of $110.00 including GST, plus any outstanding balance must be paid prior to activation being granted.

16. Collection Agency- If there is no contact with our accounts department, the matter will be placed in the hands of a Collection Agency without notice to the client and the client will be responsible for all charges incurred.

17. Changes- Should you wish to change your monthly payment method (we require two weeks notice) please contact our accounts department (accountenquires@sitezero.com.au).

18. Termination - It is your responsibility to notify SiteZero Internet Pty Ltd in writing via e-mail of your intention to cancel your account (14 days notice). 

19. Domain Parking - Should the client wish to terminate use of the SiteZero CM System but maintain domain specific e-mail addresses e.g. you@yourdomainname.com.au a monthly charge will apply. Please Contact our accounts department.

20. GST -  all monthly ongoing payments and charges include GST. SiteZero Internet Pty Ltd is registered for GST and our ABN is 27 123 607 938

21. SiteZero Internet Pty Ltd reserves the right to terminate the SiteZero CM System account of any client who breaches these Terms and Conditions. SiteZero Internet Pty Ltd at all times reserves the right to terminate a client access for any reason that SiteZero Internet Pty Ltd deems appropriate.
